HS&S Represents Longtime Client The Milford Bank in Suit Against Insurance Agent, As Reported by Law360.
08/28/2026This week, Law360 reported on the lawsuit filed by Hurwitz Sagarin & Slossberg on behalf of The Milford Bank and its subsidiary, TMB Insurance Services, against the bank’s insurance agent, BANC Insurance Agency (BIA).
The lawsuit comes after an October 2025 data breach suffered by Milford Bank’s third-party vendor. The bank promptly reported the incident to BIA days later and was assured that the claim would be reported to the bank’s cyber liability carrier. However, the carrier had no record of the claim until after December 1, 2025, when Milford Bank forwarded BIA a copy of the lawsuit it had been served regarding the breach.
According to the complaint, BIA repeatedly reassured Milford Bank that the claim was being handled and that BIA was in contact with the carrier. The complaint alleges that those reassurances were false. Milford Bank alleges that BIA did not report to the claim to the carrier within the required 30-day window, ultimately resulting in the carrier formally denying at least partial coverage, due to the delay in notice.
The suit seeks to recover the breach response expenses Milford Bank incurred between October and December 2025, including credit monitoring and identity theft protection for approximately 12,000 affected customers.
