The article highlighted the court’s concern that Dr. Carlon Colker and his legal team had not complied with prior orders requiring full production of medical records and associated documents related to Ms. Grant’s treatment.
During the hearing, Judge David Bothwell noted that the records produced to date did not sufficiently identify who paid for Grant’s medical visits or clarify the associated documentation. He reiterated that the earlier order requiring payment records to be produced was not being taken seriously and advised that new directives compelling compliance would be issued shortly.
As reported by Law360, an attorney in Ms. Grant’s legal team – HS&S Partner Erica Oates Nolan – explained that the request for complete records was narrow and supported by evidence indicating that Dr. Colker accessed Grant’s medical files long after her treatment ended. Those access dates aligned with federal search activity involving Vince McMahon, raising questions about whether additional records or communications exist that have not yet been disclosed. Additionally, Attorney Nolan argued that the defendants have refused to comply with the rules of the Connecticut Practice Book, including conducting good faith searches for responsive documents and disclosing whether they were withholding documents that were responsive to Ms. Grant’s document requests.
The court also cautioned that general objections to producing documents would not be permitted, and any specific disputes must be brought directly before the judge.
